1.根据现有劳动法规定,辞职通知期满后未休年假是否需要折算工资?
2.虽然劳动法未规定辞职时未休年假的折算,但公司员工手册规定折算工资的,是否以员工手册为准?

针对第一个问题: 如果员工辞职后,如其仍有应休的年休假未休,且是由于公司未予安排的原因造成这种情况,则公司应当向其支付相应经济补偿。 针对第二个问题: 如果员工手册有特别规定,且该规定不违反法律规定的,以员工手册为准。
