Lately, the Supreme People's Procuratorate ("SPP") has distributed the Circular on Issuing the Ninth Batch of Guiding Cases of the Supreme People's Procuratorate (the "Circular") to interpret the law through cases and strengthen prevention against and crackdown upon crimes in computer network.
The Circular expressly states that the ninth batch of guiding cases comprises six cases (Jian Li No. 33 – No.38), i.e. the "case where a criminal called Li Binglong damaged the computer information system", the "case where criminals, including a person named Li Junjie, damaged the computer information system", the "case where two criminals known as Zeng Xingliang and Wang Yusheng attacked the computer information system", the "case where three criminals named Wei Menglong, Gong Xu and Xue Dongdong respectively had illegal access to data in the computer information system", the "case where an individual named Zhang Simao stole a domain name", and the "case where four criminals, including one called Dong Liang, defrauded car-hailing app operators of subsidies". For each of these cases, the Circular states its key words, basic case facts, litigation processes and results, gist, guiding implications, and applicable legal provisions. According to relevant judicial interpretations, procuratorial organs at all levels are required to refer to those guiding cases published by the SPP while hearing similar cases.
