Recently, the National Development and Reform Commission ("NDRC") and the National Energy Administration ("NEA") have issued the Implementing Opinions on Advancing the Reform and Development of the Field of Power Work Safety (the "Opinions").
The Opinions provide for 50 specific requirements in ten respects, including "implementing responsibilities for work safety in the power sector", "establishing and improving the pre-control system for work safety" and "reinforcing administration of the construction safety and quality of construction projects". Further, the Opinions require that power enterprises shall optimize the mechanisms in respect of the management of safety qualification access and the reference for business evaluation of access, and run the "dual-reporting" system of safety and credit standing of contracting entities and management personnel and the "dual-review" system of safety qualifications and safety records for constructors; the systems for taking out the work safety liability insurance, providing services and making appraisals in this regard shall be improved, and insurance institutions will be encouraged to adopt the floating premium rate, depending on the work safety conditions. Furthermore, the Opinions clearly specify the need to strengthen the administration of contracting out projects, bring contracting entities under the construction safety management system, and prohibit the act of contracting out projects but disregarding the safety and quality thereof.
