The Department of General Affairs of the National Energy Administration ("NEA") has recently issued the Inventory of Acts Associated with the Credit Standing of Market Players in the Energy Industry (2018 Edition) (the "Inventory"), effective from the issue date.
The Inventory comprises four sections, including the "list of acts to be punished (applicable to legal persons)", the "list of acts to be punished (applicable to natural persons)", the "list of acts to be incentivized (applicable to legal persons)", and the "list of acts to be incentivized (applicable to natural persons)". In particular, the "list of acts to be punished (legal persons)" consists of five categories respectively concerning the "security", "electricity", "coal", "oil and gas" and "others", including a total of 127 kinds of behavior, such as "the act of a contractor to sub-contract the complete project it undertakes or illegally divide such project into smaller parts to have them subcontracted to several other parties". As to the "list of acts to be punished (applicable to natural persons)", the "list of acts to be incentivized (applicable to legal persons)", and the "list of acts to be incentivized (applicable to natural persons)", each list comprises three categories, with 50, 14 and 11 kinds of specific behavior respectively. In each section, certain content, including the specific credit-related behavior, category, criteria for punishment against the credit-related behavior, seriousness of credit-related behavior, and basis for identifying the credit-related conduct.
