The State Administration of Work Safety ("SAWS") has recently issued the Implementing Measures for Awarding Joint Incentives to Subjects of Good Faith in Work Safety Field (the "Measures"), immediately effective from the issue date.
The Measures expressly state that manufacturers and business operators must have six requirements fulfilled, including "not subject to any administrative fine imposed by the safety supervisory authority in the past three years", in order to be identified as targets eligible for the program of advocating faithful practices via joint incentives. According to the Measures, the administration by jointly stimulating manufacturers and business operators shall be calculated beginning from the date this circular is issued and continue for three years. Moreover, the Measures state that with regard to manufacturers and business operators considered as joint incentivized players of good faith, all levels of safety supervisory authorities may grant joint incentives through six types of measures, such as "reducing the frequency of law enforcement inspections over these market players when they are preparing the schedules for law enforcement inspections". Furthermore, the Measures stress that if any manufacturer or business operator becomes qualified for the joint incentive program by providing false information or by other unjustified means, it will not only be excluded from the administration by joint incentives for faithful acts, but also be brought into the "blacklist" of joint disciplinary actions against dishonest practices in work safety field.
