The General Administration of Quality Supervision, Inspection and Quarantine ("AQSIQ") has recently formulated and issued the Measures for the Supervision and Administration of Inspections and Quarantine Tests for Border Trade (Draft for Comment) (the "Draft for Comment") for public consultation by February 21, 2018.
The Draft for Comment, comprising 33 articles in six chapters, applies to the exchange and trading of goods by border residents and the petty trade on the border. Further, the Draft for Comment clearly specifies that any good that is prohibited from entering the territory under laws and regulations shall not be imported via the border trade. Commodities imported via the border trade shall undergo on-site inspections and quarantine tests at the port of entry or at the place where border residents exchange and trade goods. As to those exported in the name of border trade, inspections and quarantine tests shall be performed at the place where the commodities are manufactured or where they are collected and distributed, or at the port of exit. Moreover, the Draft for Comment notes that goods imported through the border trade could be checked whether they are quality products by reviewing documents about these imports, performing on-site inspections or having tests in the laboratory. The department responsible for inspections and quarantine tests may designate a place where commodities imported through the border trade shall be stored, and prohibit the sale and use of these imports before inspections and quarantine tests are completed. Where the products imported through the border trade fail to pass the inspections and quarantine tests, the importation shall be banned.
