The General Administration of Quality Supervision, Inspection and Quarantine ("AQSIQ") has recently formulated and issued the Provisions for the Supervision and Administration of the Sanitation at Border Ports (Draft for Comment) (the "Draft for Comment") and the Decision on Revising the Administrative Measures for Sanitation Licensing at Border Ports (Draft for Comment) to solicit public opinions from the general public by February 21, 2018.
It is clearly stated that the Draft for Comment applies to undertakings engaged in manufacturing and trading foods, supplying drinking water, operating public places or running places for the storage of inbound and outbound goods, border operators and undertakings operating conveyances that enter and depart from China's territory, at border ports. Further, the Draft for Comment stipulates that border ports and conveyances carrying imports and exports shall have four sanitary requirements fulfilled, such as "treating household garbage and domestic sewage in a harmless way and taking actions to prevent it from polluting the environment and sources of water and have the pollution, if any, under control". According to the Draft for Comment, if an undertaking that supplies foods to conveyances entering and leaving the territory has obtained the sanitary license for border ports, it may supply foods at nationwide ports to inbound and outbound conveyances.
