The State Administration for Industry and Commerce ("SAIC") has recently distributed the Circular on Strengthening the Application and Administration of the National Enterprise Credit Information Publicity System (the "Circular").
The Circular underscores the need to gather enterprise-related information in a timely and comprehensive manner, speed up promoting the synergy and sharing of data, combine online and offline regulation in a deep-going manner, and deepen and broaden the application of data resources. Further, the Circular explicitly states that information, such as registration and record-filing, registration of movable collaterals, registration of pledged equities, registration of pledged intellectual property rights, trademark registration, administrative penalty, results of random checks and inspections, joint punishment and incentives, simplified deregistration, the directory of enterprises with abnormal business operations, and the name list of enterprises with serious violations and dishonest behavior (the so-called "blacklist"), generated from the duty performance according to law, shall be gathered together in a real-time way. In addition, the Circular calls for practically implementing the "dual notification" duties, implying that enterprises, whose business scope is subject to post examination and approval, shall be informed of the approval items and authorities to which applications for approval shall be submitted, and, at the same time, information about enterprises' registration shall be pushed in a targeted manner or via the platform to approval authorities. Moreover, the Circular requires developing and improving technical approaches and administrative systems for alerts and exhortation.
