The Ministry of Industry and Information Technology ("MIIT") has recently issued the Administrative Measures on the Work Safety Training for Manufacturers and Sellers of Civil Explosives (Draft for Comment) (the "Draft for Comment") to seek public opinions by August 16, 2018.
The Draft for Comment explicitly states that a civil explosives enterprise shall establish and improve its management system for work safety training, draw up an annual plan for work safety training, make clear which unit is responsible for organizing work safety training activities, staff itself with full-time or part-time management personnel for work safety training, and set aside educational training expenses at the rate announced by the State. According to the Draft for Comment, a civil explosives enterprise may either organize training activities by itself, or commission a training agency that satisfies the rules set out in the Basic Conditions of Work Safety Training Agencies. Furthermore, the Draft for Comment provides that, each civil explosive enterprise shall establish and improve the mechanism of work safety training records for practitioners, and generate such records for each practitioner; also, it is required to form records for each work safety training session it has organized. Moreover, the civil explosives enterprise shall pay practitioners the corresponding salaries during the training period and have their necessary expenses reimbursed.
