The Ministry of Transport ("MOT") has recently drafted and issued the Provisions on Procedures for the Formulation of Transport Regulations (Draft for Comment) (the "Draft for Comment") to seek public comments by August 19, 2018.
Major revisions introduced by the Draft for Comment extend to the following eight aspects. The first is further strengthening protection of rights and interests of citizens, legal persons and other organizations. The second is improving the solicitation of legislative programs and optimizing the project demonstration system. The third is improving the regime of soliciting public opinions on draft legislation. The fourth is establishing the demonstration and consultation system for major interest adjustments. The fifth is intensifying legislation coordination. The sixth is optimizing the legislation review mechanism. The seventh is improving the system of sorting out regulations and conducting the post-legislation assessment. And the eighth is further improving the legislative work mechanism for national bureaus under the MOT, in line with requirements on deepening the ministerial reorganization. Furthermore, the Draft for Comment provides that the unit responsible for legislation drafting is required to seek public comments on the draft law at the drafting stage, compared with the public consultation at the review stage in the past, and the period of public comment shall generally last 30 days at least.
