The General Office of the Ministry of Housing and Urban-rural Development ("MOHURD") has recently issued the Circular on Matters Concerning Simplifying Materials Needed for Applying for Qualifications of Construction Engineering Enterprises (the "Circular"), with effect from October 8, 2018.
The Circular provides that: 1. in applying for the qualification as an engineering survey enterprise, an engineering design enterprise or an enterprise engaging in the construction industry (including applying for upgrading, renewing or changing such qualification), the corporate applicant does not have to provide its qualification certificates, proof of identities of certified practitioners and their certificates, in that the qualification issue authority will access and check, by itself, relevant data in the national public service platform for the construction market regulation; 2. in applying for the qualification as an engineering survey enterprise, an engineering design enterprise or an enterprise engaging in the construction industry (including applying for the first time for, and applying for upgrading, renewing or changing, the qualification), the corporate applicant will not be required to furnish proof materials pertaining to social insurance contributions made for relevant personnel, and instead, the legal representative of the enterprise applying for the qualification shall sign a commitment on the truthfulness and effectiveness of information regarding social insurance contributions made for relevant personnel and bear the corresponding legal liability; 3. all levels of housing and urban-rural development authorities shall take full advantage of information sharing and other means to verify the realness of information about personnel involved in applications filed by enterprises and strengthen the dynamic oversight of qualifications of construction engineering enterprises.
