The Ministry of Transport ("MOT") has recently issued the Administrative Measures on Road Transportation Safety for Dangerous Goods (Draft for Comment) (the "Draft for Comment") for public consultation by March 14, 2019.
The 79 articles of the Draft for Comment are organized into ten chapters which include "General Provisions", "Consignment of Dangerous Goods", "Special Provisions on the Transportation of an Exceptional or Limited Number of Dangerous Goods" and "Acceptance of Consignment of Dangerous Goods". Among others, the Draft for Comment notes that enterprises or units engaged in transit of dangerous goods by road shall use conveyances and equipment that meet requirements regarding safety specifications in national standards and are suitable for the nature and weight of dangerous goods transported, and designate, as required, drivers and supercargoes who have acquired the practicing qualification for road transportation of dangerous goods to transport the goods. Furthermore, the Draft for Comment expressly states that, manufacturers of vehicles used to transport dangerous goods shall manufacture vehicles according to the product models announced by the competent authority of industry and information technology, and obtain the China Compulsory Certification certificates for carrier vehicles they have manufactured for transit of dangerous stuff.
