The National Development and Reform Commission ("NDRC") has recently issued the Measures for the Supervision and Examination of Power Transmission and Distribution Pricing Costs (Revised Draft for Comment) (the "Draft for Comment") for public consultation by April 28, 2019.
The Draft for Comment encompasses 28 articles divided into five chapters that are respectively entitled "General Principles", "Constitution of Power Transmission and Distribution Pricing Costs", "Assessment of Power Transmission and Distribution Pricing Costs", "Duties of Business Operators" and "Supplementary Provisions", with one new chapter and 10 articles added and 17 articles modified. Key revisions introduced this time touch upon: 1. making the supervision and examination more scientific; 2. refining the supervision and examination; and 3. standardizing the supervision and examination. Among others, the Draft for Comment gives further details about how to categorize and examine power transmission and distribution pricing costs, adds and provides clarity on items that cannot be included in the power transmission and distribution costs, sets out clear requirements and procedures regarding enterprises' reporting of information, and provides for disciplinary measures against discreditable acts, aimed at improving the quality of information reported by enterprises and the efficiency of information reporting.
