The Civil Aviation Administration of China ("CAAC") has recently prepared and issued the Circular on Further Implementing the Requirement of Setting Appropriate Limits on Opportunities of Certain Seriously Dishonest Individuals to Take Civil Aviation Flights within Prescribed Time Limits (Draft for Comment) (the "Draft for Comment") for public consultation by June 29, 2019.
The Draft for Comment clearly states that individuals subject to the limits are seriously dishonest individuals and parties subject to enforcement that are restricted from taking civil aviation flights under the Several Provisions of the Supreme People's Court on Restricting Parties Subject to Enforcement from High Consumption and Relevant Consumption and the Opinions on Setting Appropriate Limits on the Opportunities of Certain Individuals with Serious Dishonesty to Fly on Civil Aircraft within Given Time Limits and Promoting the Building of the Social Credit System. The Draft for Comment notes that contracting carriers and sales agents of passenger transport shall refuse to provide certain individuals of extreme bad faith with the following air transportation services: irregular public air transportation; regular general aviation transportation (short-distance transportation); irregular general aviation transportation (chartered flights). Actual carriers shall not offer them the business aviation services. Carriers or sales agents that refuse to comply with this requirement or inadvertently offer air transportation services to certain individuals that are seriously dishonest, will be ordered to take corrective actions within prescribed time limits.
