The Ministry of Emergency Management ("MEM") has recently issued the Decision on Amending the Administrative Measures for Contingency Plans for Work Safety Accidents (the "Decision"), with effect from September 1, 2019.
The Decision revises Paragraph 1 of Article 4 to read: "The Ministry of Emergency Management takes charge of overall coordination and management of nationwide contingency plans, while other departments of the State Council that bear responsibility for supervision and administration of work safety are responsible for management of contingency plans for relevant industries and fields, within their respective duties". In addition, the Decision replaces the term "assessment of accident risks" in Paragraphs 1 and 2 of Article 10 with "identification and assessment of accident risks", and accordingly revises the term "conclusions of the assessment of accident risks" in Paragraph 3 to read "conclusions of the identification and assessment of accident risks". Furthermore, the Decision introduces modifications to Article 1, Article 2, Paragraph 1 of Article 11, Article 12, among others.
