The Department of Aircraft Airworthiness Certification of the Civil Aviation Administration of China ("CAAC") has recently prepared and issued the Decision on Revising the Provisions on Registration of Civil Aircraft Nationality (Draft) (the "Draft") to seek comments from the entities concerned by August 29, 2019.
The Draft revises the original Article 1 to read: "for the purpose of enhancing administration of civil aircraft nationality, safeguarding the safety of civil aviation activities and maintaining the order of civil aviation activities, these Provisions are formulated in accordance with the Civil Aviation Law of the People's Republic of China, the Administrative Licensing Law of the People's Republic of China and the Regulations of the People's Republic of China on Registration of Civil Aircraft Nationality." In Addition, Item 2 under Article 5 is revised to read: "2. Civil aircraft of enterprise legal persons established in line with laws of the People's Republic of China", while Item 2 under Article 10 is revised to read: "2. The purchase agreement proving the obtaining of the ownership of the civil aircraft and the delivery documents, or the lease contract proving the occupation of civil aircraft and the delivery documents, or other documentation". The Draft also proposes modifications to Article 18 and Article 29.
