The Ministry of Emergency Management ("MEM") has recently drafted and issued the Guide to Classified Management and Control of Safety Risks for Metal and Non-metal Mine Enterprises (Draft for Comment) (the "Draft for Comment") to seek comments from the entities concerned by August 30, 2019.
The Draft for Comment is comprised of eight parts which are the scope, referenced normative documents, terms and definitions, basic requirements, classified risk management and control, surveys for classified risk management and control, etc. The Draft for Comment sets out general requirements for work of metal and non-metal mine enterprises on classified management and control of safety risks, and makes it clear that it does not apply to mine enterprises engaged in the exploitation of liquid or gaseous mineral reserves, coal measures, or mineral reserves associated with coal. In addition, the Draft for Comment notes that enterprises shall, under the basic principles for classified risk management and control, reasonably determine the levels at which different risks will be managed and controlled, generally including the company- (mine-) level, the department- (office-) level, the unit- (workshop-) level and the post- (team-) level, adding that major risks, relatively serious risks, general risks and minor risks should be managed and controlled at the company, department, unit and post level respectively.
