The State Council has recently distributed the Guiding Opinions on Strengthening and Standardizing the In-process and Ex-post Regulation (the "Opinions").
The Opinions outline policy-level measures in five aspects, including: 1. intensifying regulatory responsibilities; 2. improving regulatory rules and standards; 3. innovating and perfecting the regulatory means; 4. shaping a layout of coordinated regulation; and 5. enhancing regulatory standardization and transparency. Among others, the Opinions clearly state that in principle, all routine administrative inspections among enterprises should be carried out under the "dual randomness and one publicity" mechanism. Special key areas that have a direct bearing on public safety or people's life or health, will be all closely supervised in accordance with laws and regulations. Also, the "Internet plus regulation" will be advanced to make regulatory efforts better targeted and more intelligent. Credit-rating-based regulation will be promoted by industry category, under which dishonest market players will face restrictions on industry access, project examination and approval, etc. Moreover, the inclusive and prudent regulation will be implemented among emerging industries. Furthermore, the Opinions call for standardizing administrative inspections and penalties on enterprises, lifting repeated or unnecessary inspected matters, and prohibiting the formation of links between the amount of penalties and the benefits of administrative law enforcement organs.
