The Ministry of Justice ("MOJ") has recently issued the Administrative Measures for Registration of Arbitration Commissions (Draft for Comment) (the "Draft for Comment") to seek opinions from the units concerned and all walks of life by October 11, 2019.
On the basis of the previous Interim Measures for Registration of Arbitration Commissions, the Draft for Comment further details, supplements and improves the measures in accordance with the Arbitration Law, reflecting the latest requirements set out in relevant documents issued by the Central Committee of the Communist Party of China ("CPCCC") and the State Council. Highlights of the Draft for Comment include: 1. specifying the circumstances under which the proposed registration will be dismissed; 2. clarifying the record-filing procedures for registration of their branches; 3. adding contents regarding the reexamination of the change of commission members; 4. providing further details about the deregistration; 5. providing for the content and forms of supervisory checks performed by registration authorities over arbitration commissions; 6. introducing the provisions in respect to credit building; and 7. adding the record-filing provisions in respect to registration of the China International Economic and Trade Arbitration Commission ("CIETAC"), the China Maritime Arbitration Commission ("CMAC") and the Arbitration Center Across the Straits ("ACAS"), as well as their branches.
