The National Radio and Television Administration ("NRTA") has recently issued the Implementation Plan for Fully Promoting the Administrative Law Enforcement Publicity System, the Law Enforcement Whole-process Recording System, and the Legal Review System for Major Law Enforcement Decisions (the "Plan") and the Administrative Measures for Administrative Law Enforcement Certificates.
The Plan states that, by upholding the principles of law-based and standardized enforcement and people-oriented enforcement, the NRTA will fully promote the "three systems", to effectively regulate the practices of administrative law enforcement, such as administrative licensing, administrative inspections and administrative penalties, constantly improve the law enforcement system, standardize the law enforcement procedures and innovate the means of law enforcement, focus on stricter supervision of law enforcement and precautions against risks in law enforcement, ensure impartial and civilized law enforcement, and enhance the capacity and level of administrative law enforcement. To this end, the Plan outlines arrangements from various aspects, including "strengthening publication beforehand", "standardizing in-process publicity" and "improving ex-post publicity", regarding the implementation of the said three systems, including "administrative law enforcement publicity system". According to the Plan, unless otherwise stipulated by laws and administrative regulations, information about decisions on administrative law enforcement, such as administrative licensing and administrative penalties, should be made public within seven working days from the date of making decision.
