The Law of the People's Republic of China on Promotion of the Culture Industry (Draft for Review) (the "Draft for Review"), drawn up by the Ministry of Culture and Tourism ("MCT"), has been recently released by the Ministry of Justice ("MOJ") for public comment by January 13, 2020.
The Draft for Review contains 75 articles divided into nine chapters which include creation and production, cultural enterprises, culture market, talent guarantee, scientific and technological support, financial and fiscal support, and legal liability, among others. Structurally centered on key processes and core factors for promoting the development of the culture industry and focused on two key problems, namely "in what aspects the development will be promoted" and "how to promote the development", the Draft for Review stresses great efforts in three key processes of creation and production, cultural enterprises, and culture market, and calls for support in aspects of talent, science and technology, and financial and fiscal policies. Specifically, the Draft for Review mainly touches upon: 1. clearly defining the scope of regulation of this law; 2. legislating for cultural economic policies that are proved effective; 3. implementing the central government's latest plans and requirements regarding the development of the culture industry; and 4. making institutional arrangements for sustaining the national ideology and ensuring the cultural security.
