The State Council has recently issued the Decision on Revising and Repealing Certain Administrative Regulations (the "Decision"), with effect from the date of issuance.
The Decision incorporates changes to certain articles in seven administrative regulations, and repeals ten administrative regulations including the Regulations on the Administrative Protection for Drugs. Among others, for the purpose of cancelling some administrative licensing items, three administrative regulations including the Implementing Rules of the Fisheries Law are amended, with the confirmation of the qualification of operators of weather modification, the examination and approval process for clinical trials of new veterinary drugs, etc. cancelled and the articles related to relevant regulatory measures and legal liability improved. As a move to optimize the examination and approval formalities, the Regulations on Nurses are modified by shifting the authority for examination and approval regarding nursing practice registration from the provincial health authority to the competent health authority responsible for the approval or record-filing for the establishment of the medical institution where the nurse concerned practices. For the sake of better business environment, the Administrative Regulations on Urban Real Estate Development and Operation are revised by further reducing the certification items. Moreover, revisions aimed at enhanced follow-up regulation are made, including introducing the record-filing regulatory measure into the Regulations on Weather Modification, to urge relevant departments to step up their supervision of the relevant activities after certain administrative licensing items have been cancelled.
