The General Office of the State Administration for Market Regulation ("SAMR") has recently issued the Circular on Carrying out a Survey of Hidden Hazards in Product Quality and Safety of Dangerous Chemicals as well as Their Packaging and Vehicle-mounted Tanks (the "Circular").
The Circular articulates five major tasks: 1. directing enterprises to conduct self-inspections to ensure the fulfillment of their primary responsibility for quality and safety; 2. carrying out a survey to detect hidden quality and safety hazards in the production area; 3. severely clamping down upon quality violations; 4. urging enterprises to rule out hidden quality and safety hazards; and 5. further strengthening the monitoring of quality and safety risks. Among others, the Circular states that each provincial market regulator shall, in light of the local condition in monitoring of quality and safety risks, provide further clarity on the key areas, major products, main indicators, and key problems, and under the "dual randomness and one publicity" mechanism, inspect whether enterprises having obtained the production permits continues to maintain the conditions for obtaining the permit, pursuant to the implementing rules for the production permit for each type of product, and when necessary, inspect the product quality in line with the requirements set out in the Product Quality Law.
