The Ministry of Natural Resources ("MNR") has recently issued the Circular on the Administration of Land Use Plans for 2020 (the "Circular").
The Circular states that land quotas will be directly allocated to the land needed for those priority projects, during the land approval process, adding that the land needed for the priority projects includes the land required by projects on the national list of major projects and the land required by projects on the provincial government's list of major projects relating to energy, transportation, water resources, military facilities and industries that need to be built on separate locations. Additionally, the Circular expressly states that for the land needed by other projects not prioritized, the quotas to be allocated will be linked to the disposition of stock land. To be more specific, the quotas will be set at 50% of the area of the settled land out of the land that has been approved by the end of 2017 but not yet granted, at 30% of the area of the settled land out of the land that has been approved by the end of 2018 but not yet granted, and at 50% of the area of the settled land out of the idle land that should be resolved in the current year. The Circular also provides for the incentive policies and the regulatory assessment.
