Recently, the Supreme People's Procuratorate ("SPP") and two other departments have issued the Opinions on Establishing the System for Inquiry about Sexual Assault Information for Admission of Faculty and Staff (the "Opinions").
The main contents of the Opinions include: 1. the scope of inquiry; 2. the scope of personnel to which the entry inquiry applies; 3. The inquiry methods. 4. the application of inquiry results and the accountability. Among others, the Opinions require the inquiry about three types of personnel: first, newly recruited teachers, administrative staff, odd-job men, and security personnel of and other staff members working in primary and secondary schools (including secondary vocational education and special education schools) and kindergartens, are subject to sexual assault information inquiry before they are employed. Second, teacher qualification accreditation agencies shall conduct sexual assault information inquiry against applicants before certifying their teacher qualifications. Third, administrative departments for education shall effectively screen the relevant illegal and criminal information of in-service faculty and staff. In addition, the Opinions also make it clear that the Opinions apply mutatis mutandis to sexual assault information inquiries against faculty and staff of colleges and universities and out-of-school training organizations targeting minors.
