The National Energy Administration ("NEA") has recently issued the Guiding Opinions on Strengthening Follow-up Supervision of Cancelled and Delegated Administrative Examination and Approval Items (2020 Edition) (the "Opinions"), which shall take effect from the date of issuance with the valid period of five years.
The Opinions cover 15 measures, such as strengthening the classified supervision of cancelled examination and approval items and enhancing the key supervision of delegated examination and approval items, in five aspects including clarification of supervision tasks. In particular, the Opinions propose to speed up the establishment of sound national standards and industrial standards, revise and adjust existing standards in a timely manner, accelerate the research and formulation of standards for new industries and new business forms, and conduct supervision in strict accordance with the standards. The Appendix attached to the Opinions clarifies 15 cancelled administrative examination and approval items in total, including the "pilot program for direct purchase of electricity by power users from power generation enterprises" and "examination and approval of the standard-reaching and rating of electric power standardization in work safety", and 14 delegated administrative examination and approval items, including the "examination and approval of wind power plants (wind power projects)" and "electric power business licenses (power generation, transmission, and power supply)". The Appendix also specifies the corresponding follow-up supervision measures for various matters.
