The State Administration of Work Safety ("SAWS") and four other authorities have jointly released the Circular on Matters concerning the Addition of Emergency Shutdown Devices to Tankers for Dangerous Liquid Goods in Use (the "Circular").
The Circular requires manufacturers, retrofitters and users of tankers for dangerous liquid goods to effectively carry out the addition of emergency shutdown devices. The Circular clarifies that, starting from January 1, 2015, failure to retrofit a tanker for dangerous liquid goods with emergency shutdown devices as required will be subject to a strict liability investigation. The Circular further clarifies that, starting from January 1, 2015, transport authorities will fail the annual examination of any tanker for dangerous liquid goods that has not been retrofitted with the emergency shutdown devices or obtained the safety technology compliance certificate, with its road transport certificate revoked.
