On August 1, the State Post Bureau ("SPB") released the Draft Measures for the Supervision of Postal Administrative Enforcement (Draft for Comment) (the "Draft") to solicit public comments by August 31, 2014.
The Draft consists of 56 articles in seven chapters covering provisions on the general principles, supervisory organs and their responsibilities, supervision scope and approach, supervision procedures and treatment, accountability for administrative enforcement liability, legal liability, and supplementary provisions. According to the Draft, where postal administrative enforcement activities damage the legitimate rights and interests of citizens, legal persons or other organizations, and such activities are confirmed in the postal administrative enforcement supervision procedures to be in violation of laws, the competent postal administrative authority shall make administrative compensation in accordance with the law.
