The National Health and Family Planning Commission has released the Provisions on Prohibiting the Identification of Foetus Sex and Termination of Pregnancy Based on Sex Where There Is No Medical Need (Draft for Comment) for public comments. The deadline for submitting comments is October 2, 2014.
Under the Draft for Comment, it is prohibited for any entity or individual conduct the activity of identifying the sex of a foetus and terminating pregnancy based on sex where there is no medical need, or that any entity or individual recommend or organize such activity.
If the statutory conditions for bearing a child are satisfied, no one may terminate the pregnancy based on sex except in the following circumstances: the foetus is attacked by a severe hereditary disease; the foetus has serious defects; the life of the pregnant woman is likely to be endangered or the health of the pregnant woman is likely to be severely impaired if the pregnancy is allowed to continue due to severe illness; other circumstances as provided by regulations and rules.
