The National Development and Reform Commission ("NDRC") has released the Circular on Further Implementing the Registration and Announcement of the Capacity of Coal Mines (the "Circular").
The Circular requires acceleration of the work process of the registration and announcement of coal mines' capacity. The registration and announcement of the current coal mines' capacity shall be completed by September 30, and if any coal come fails to do so, the competent authority shall suspend the approval of any increase in its capacity and restrict its production according to the relevant laws and provisions. Under the Circular, all places shall strengthen the inspection of coal mines' capacity according to the judging criteria and only legally operating coal mines with all the necessary licences may register and announce their capacities; those without all the necessary licences and the criteria for determining their capacities may not register and announce their capacities. In addition, the Circular requires that all places should timely have coal mine enterprises sign a commitment to production to ensure the accuracy of information in the registration and announcement of coal mines' capacity
