The State Administration of Work Safety has issued the Administrative Regulations on the Occupational Hazard Notifications and Warning Signs of Employers (the "Regulations").
The labourers referred to under the Regulations include those who work for an employer in the form of a labour contract, engagement contract, labour dispatch, etc. The Regulations require employers to truthfully inform their labourers of the occupational hazards that may arise in their work places, set up bulletin boards for occupational disease prevention in prominent places, and set up warning signs in the operation locations where serious occupational hazards may arise and at the places where the equipment, materials, and warehousing facilities that may cause occupational hazards are located. According to the Regulations, when an employer and a labourer conclude a labour contract (including an engagement contract), the occupational hazards that may arise in the working process, their consequences, the protective measures for the occupational hazards and the benefits (such as job subsidies, work-related injury insurance, etc.) shall be clearly stipulated in the labour contract. And an employer shall inform its labourers working for it in the form of labour dispatch of the aforementioned provisions in writing.
