The General Administration of Quality Supervision, Inspection and Quarantine has recently issued the Provisions on the Post-Event Handling of Manufacturers of Products Failing the State Supervisory Spot Check on Product Quality (the "Provisions"), for implementation as of July 1, 2015.
Under the Provisions, the post-event handling of manufacturers of products failing the state supervisory spot check on product quality refers to the adoption, in accordance with the law, of administrative measures such as bulletins, orders to make rectifications, re-checks, public notices, and administrative sanctions towards manufacturers of products failing the state supervisory spot check on product quality According to the Provisions, in the event that manufacturers of failed products are unable to make rectifications due to an actual inability to conduct normal production, they shall provide valid proof for such inability and stop the production of similar products and shall, after resuming normal production of the failed products, make rectifications as required and apply for a re-check. Before they pass the re-check, they shall not continue to manufacture and sell products of the same specifications. Manufacturers which have failed the re-check shall be ordered to stop production and make rectifications within 30 days by the post-event handling authority.
