The China National Tourism Administration ("CNTA") has issued the Opinions on Cracking down on the Organization of "Unreasonable Low Price Tours" and the Opinions on Cracking down on the "Deceitful or Compulsory Tourism Shopping" in Tourist Activities.
The Opinions on Cracking down on the Organization of "Unreasonable Low Price Tours" indicate that, the so called "unreasonable low price" means that a travel agency attracts tourists with a false price which is lower than its operating cost by deviating from the law of value, lures tourists into consumption by false promotion, and disrupts the market by unfair competition. In view of the above, the prices of tourism products of a travel agency shall not be less than 30% of the credit-guided tourism prices released by the local tourism authority or tourism trade association. According to the Opinions on Cracking down on the "Deceitful or Compulsory Tourism Shopping" in Tourist Activities, all the following activities among others may be identified as "deceitful or compulsory tourism shopping": a travel agency arranges shopping without written consent of tourists; a travel agency, tour guide or leader of a group tour forces tourists to go shopping by making physical threats or intimidation, or by committing other acts; or a travel agency, tour guide or leader of a group tour arranges a shopping place which is operated illegally or which is not open to the public.
