Recently, the Supreme People's Court has issued the Provisions on the Online Disclosure of Decision Documents by the People's Courts (the "Provisions"), which shall come into force as of October 1, 2016.
The Provisions specify that the decision documents to be duly disclosed on the internet shall include ten types of decisions, including "criminal, civil, and administrative judgements", "criminal, civil, and, administrative verdicts", and "payment orders"; there are five types of decision documents that shall not be published on the internet, such as "documents for cases settled via mediation or those with the confirmed validity of civil mediation agreements, unless it is necessary to publish such documents so as to protect national interests, social and public interests, and the legitimate rights and interests of others". According to the Provisions, the people's courts shall remove six types of information, including the bank accounts, vehicle license numbers, and the numbers of ownership certificates for movables and immovable properties of the legal persons and other organizations concerned, before uploading decision documents on the internet. Also, the Provisions point out that the scope of such disclosure shall be clearly stated in the case acceptance notices and the notices of respondence to action.
