Recently, the State Administration for Industry and Commerce has formulated and issued the Implementing Measures for 7-day Unconditional Return of Online Purchased Goods (Draft for Comment) (the "Draft for Comment") for public comments before October 11, 2016.
The Draft for Comment mainly contains the following: the first is to specify the scope of goods not suitable for return according to the nature of goods; the second is to define the meaning of and standards on the integrity of goods; the third is to elaborate on the procedures for unconditional return; the fourth is to strengthen the supervision and administration of online trading activities. The Draft for Comment, according to the nature of goods, lists three types of goods that are not applicable to the 7-day unconditional return policy including the goods that will be greatly devalued once activated or tried, upon confirmation by consumers at the time of purchase. Additionally, the Draft for Comment defines the "general integrity of goods" as the condition under which returned goods are able to keep their original quality and functions and such goods themselves are complete with all necessary accessories, trademarks and labels, and further specifies that the act of a consumer to open up the package of a product for inspection purpose or make reasonable testing so as to confirm its quality and functions doesn't affect the integrity of such product.
