Recently, the General Administration of Quality Supervision, Inspection and Quarantine ("AQSIQ") has issued the Implementing Measures for Random Inspections of Quality Supervision, Inspection and Quarantine (the "Measures"), which shall come into force as of the promulgation date, and simultaneously released the List of Matters Subject to Radom Inspections of Quality Supervision, Inspection and Quarantine (the "List").
The Measures, encompassing a total of 21 articles, specify that the quality supervision, inspection and quarantine departments shall gradually promote the "double random" inspection mechanism, under which the inspection objects are selected at random and the law enforcement officers are randomly chosen and appointed, for administrative enforcement matters. The Measures provide that the proportion and frequency of random inspections shall be increased for inspection objects often complained or reported or with a record of serious violations or irregularities. The AQSIQ and local administrative departments of quality supervision, inspection and quarantine shall promptly publish to the public the inspection information and results; the Measures do not apply to four circumstances including "dealing with the violations of laws and regulations committed by enterprises complained or reported in accordance with laws". The List enumerates a total of 24 matters subject to random inspections, including the supervision and random inspections over imported food of importers that have completed record-filing, the supervision and random inspections on product quality by the State and the regulation of food-related product safety.
