Recently, the State Council has issued the Plan on Developing the New Generation Artificial Intelligence (AI) (the "Plan").
The Plan specifies China's strategic objectives in three phases in respect of the development of the new generation AI, and proposes major missions in six aspects, including "constructing an open and coordinated system for AI technological innovations" and "establishing an intelligent infrastructure system that is ubiquitous, safe and highly efficient". Also, the Plan calls for making studies of certain legal issues on the AI application, including ascertaining civil and criminal liabilities in this regard, protecting privacy and property rights and using information in a safe manner, and setting up the traceability and accountability systems to specify the AI legal subjects and relevant rights, obligations and liabilities. Moreover, the Plan sets forth the need to improve and put in place relevant policies on data transparency and protection, launch the pilot reform in making public and using public data, support the masses and enterprises to fully exploit commercial values of public data, and research and improve the system of policies concerning the education, medical treatment, insurance and social assistance in order to keep up with the AI trend.
