Recently, the Ministry of Transport ("MOT") has drafted and issued the Administrative Provisions on the Construction of Port Projects (Draft for Comment) (the "Draft for Comment") to seek comments from entities concerned before August 21, 2017.
The Draft for Comment, comprised of seven chapters with a total of 82 articles, provides for the management of construction procedures, management of construction implementation, management of completion acceptance and inspections, management of project information and archives, etc. According to the Draft for Comment, any new, transformation or expansion of port project requires the planning, design and construction of shore-based power supply facilities and facilities for prevention and control of water pollution. Also, port construction projects are encouraged to apply new technologies, new equipment, advanced techniques and new materials and promote the standardized management of construction quality and security. Furthermore, the Draft for Comment notes that, where a port construction project shall undergo trial operations upon completion, as required by the design, such trial operations should be conducted pursuant to the Administrative Provisions on Port Operations and a permit for port operations should be obtained for the period of trial operations.
