The State Administration for Industry and Commerce ("SAIC") has recently distributed the Circular on Adjusting the Catalog of Business Registration Matters Subject to Prior Approval (the "Circular").
The Circular states that a privately-invested school (training agency) established for profits, after obtaining the formal approval in respect of its establishment, should make a registration at the administrative department for industry and commerce in accordance with the jurisdiction stipulated by applicable laws and regulations. Accordingly, the Circular introduces adjustments again to the Catalog of Business Registration Matters Subject to Prior Approval and the Guiding Catalog of Enterprises' Alteration Registration and Deregistration Subject to Prior Approval affixed to the Circular of the State Administration for Industry and Commerce on Strictly Implementing the Reform of Issuing a Business License before an Operating Permit and Business Registration Matters Subject to Prior Approval. According to the Circular, the existing Catalog of Business Registration Matters Subject to Prior Approval includes five types of business registration matters subject to prior approval as explicitly stipulated by laws, including the permit for establishing privately-invested schools (training agencies) for profits, and another 28 business registration matters requiring advance approval that are retained according to the State Council's decision.
