Lately, the Department of Drug and Cosmetics Registration of the China Food and Drug Administration ("CFDA") has issued the Letter on Seeking Comments on Relevant Provisions Concerning the Registration and Record-filing of Certain Products after Issue of New Cosmetics Production License (the "Letter for Comment") for public comments by October 21, 2017.
The Letter for Comment states that if the site where cosmetics are manufactured in practice remains unchanged but the corporate name indicated on the newly issued Cosmetics Production License differs from that on the original one, a certification issued by the provincial food and drug administration at the place where the enterprise is located to prove that its actual production site remains the same as before should be provided as well, when formalities for registering cosmetics made domestically are handled. Further, the Letter for Comment clearly specifies that for domestic cosmetics not used for special purposes that have already been filed for record, if any information filed for record changes due to the issue of new Cosmetics Production License, the enterprise concerned should, within six months from the issue date of this announcement, log into the record-filing system for domestic cosmetics used for non-special purposes to update relevant information on its own initiative; if it fails to do so within the required time limit, the said system will cancel the record-filing information of the products automatically.
