The State Administration of Work Safety ("SAWS") has recently issued the Work Safety Provisions for Metallurgy Enterprises and Non-ferrous Metal Enterprises (the "Provisions"), with effect from March 1, 2018.
The Provisions clearly specify that an enterprise that uses the metal smelting techniques and employs over a hundred of practitioners is required to set up a department of work safety management, or allocate no less than 0.3 percent of its total practitioners to exclusively serve as the management staff for work safety, with three individuals as least. Further, the Provisions note that an enterprise shall detect to identify any internal hazards, erect safety alert marks in accordance with requirements given in applicable national standards and industry standards in areas or on facilities and equipment where there exist relatively serious dangers, and perform regular inspection and maintenance activities. According to the Provisions, any enterprise shall not adopt any technologies, techniques or equipment that do not comply with the applicable national standards or industry standards; when it has the existing techniques or equipment updated or transformed, it is not allowed to degrade their safety and technical performance.
