The State Administration of Work Safety ("SAWS") has recently released the Measures for the Supervision of Regulatory Enforcement for Work Safety (the "Measures"), immediately effective from the issue date.
The Measures stipulate that the supervision over law enforcement activities shall follow the principle of supervision and promotion, and safety regulators shall watch more closely their internal departments, specialized law enforcement agencies and law enforcement officers thereof, improve work systems and mechanisms concerning law enforcement, and boost enforcement efficiency. Meanwhile, the Measures expressly state that, safety regulators shall supervise enforcement activities by three means, such as the integrated supervision, routine supervision, and specialized supervision, adding that the SAWS shall launch a round of integrated supervision over provincial safety regulators at least every three years, while provincial safety regulators are required to carry out a round of integrated supervision over municipal safety regulators in cities with districts at least every two years. Furthermore, the Measures stress that if enforcement activities involve any violation or improper situation, the administrative enforcement liability of authorities concerned shall be pursued in accordance with the Provisions for Pursuing Supervision Liability and Administrative Enforcement Liability for Work Safety Regulation.
