The Ministry of Housing and Urban-rural Development ("MOHURD") has recently issued the Administrative Provisions on the Safety of Divisional and Partial Projects with Relatively Great Danger (the "Provisions"), with effect from June 1, 2018.
It is made clear in the Provisions that the entity contracting out the construction project shall provide truthful, accurate and complete materials about the engineering geology, hydrogeology and surrounding environment of the project. The survey entity shall, according to actual situations of the project and materials about its surrounding environment, specify likely engineering risks caused by geological conditions in survey documents. Meanwhile, the Provisions note that the entity undertaking the construction shall arrange for engineering professionals to prepare a special construction plan before the construction of a project with relatively great danger; also, it is required to publish the name of the project with relatively great danger, the construction period and persons in charge of the construction, in a prominent position on the construction site, and put safety warning signs in dangerous areas. However, if the entity undertaking the construction fails to work out and review the special construction plan for a project with relatively great danger according to the Provisions, it shall be penalized under the Regulations on the Administration of Work Safety of Construction Projects, and its work safety license will be seized on a temporary basis for 30 days; the head directly in charge of the project and other personnel held directly liable shall be given a fine ranging from over CNY1,000 to less than CNY5,000.
