The Ministry of Public Security ("MPS") and the Ministry of Transport ("MOT") have recently released the Implementing Measures for the Advance Submission and Inspection of Information on Personnel in Inbound and Outbound Aircrafts (the "Measures"), with effect from August 1, 2018.
The Measures stipulate that, persons responsible for inbound and outbound aircrafts or agencies for the exit and entry business shall report in advance the complete and accurate information about all passengers and crew members in each inbound or outbound aircraft in a timely manner, under these Measures, such information includes records of bookings made by passengers, information on passengers on board and information on crew members on board. The said persons or agencies are required to submit records of bookings made by passengers separately 72 hours, 24 hours, 2 hours and 1 hour before the departure of aircrafts and within 30 minutes after the aircrafts have taken off. In addition, the Measures expressly state that if the requested information has been submitted in advance as required, the exit-entry border control authorities and the competent authority of civil aviation under the State Council shall provide facilitation for the entry or exit of concerned aircrafts and passengers and crew members they carry. However, if the information about passengers and crew members to be carried by aircrafts is not submitted, as required under these Measures, the exit-entry border control authorities may put off or hold back the entry or exit of aircrafts operated and managed by persons responsible for such aircrafts or agencies thereof.
