MOF Issues a Policy to Implement the Accountability System for Law Dissemination under the Principle of "Letting Law Enforcers Take Charge of Law Dissemination"
The Ministry of Finance ("MOF") has recently issued the Implementing Opinions on Putting in Place the Accountability System for Law Dissemination under the Principle of "Letting Law Enforcers Take Charge of Law Dissemination" (the "Opinions").
The Opinions outline tasks and measures in seven aspects, including "developing the accountability system for law dissemination", "disseminating law to the general public with the focus on hot and complex issues" and "establishing and improving the system of citing cases to interpret law". In particular, the Opinions call for stepped up efforts to study and publicize a wide range of legal systems concerning finance and tax, including the budget law and the implementing regulations thereof, the government procurement law as well as the implementing regulations thereof, the accounting law, the certified public account law, the asset appraisal law, individual tax laws, and regulations for punishment and disciplinary actions against financial violations, and other major fiscal regimes and policies with respect to the administration of state-owned assets, financial management, etc. In the meantime, the Opinions note that when laws, regulations and rules relating to finance and tax are being drafted (amended), it is necessary to hold panel discussions or take other forms to listen to extensive opinions of the public on major issues that spark great public concerns and have a bearing on the immediate rights and interests of the general public. Drafts of laws, regulations and rules must be published for public consultation, unless they should be kept confidential according to the law.
