The General Office of the Ministry of Ecology and Environment ("MEE") has recently released the Administrative Measures on Security Licensing for Nuclear Facilities (Draft for Comment) (the "Draft for Comment") to seek opinions from the units concerned by July 30, 2018.
The Draft for Comment, comprising eight chapters and seven annexed schedules, introduces new contents and make the adjustments in the following aspects. The first is introducing principles for the category-based and hierarchical regulation; the second is changing how nuclear security licensing items are set up; the third is clarifying requirements on the regular security assessment; the fourth is optimizing administrative licensing approval items in response to the initiative proposed by the State to streamline administrative approvals; the fifth is adding articles of legal liability with respect to administration of security licensing for nuclear facilities; and the sixth is removing provisions concerning the administration of nuclear facility operators. In particular, the Draft for Comment provides further clarity on the procedures and requirements to apply for security licenses and specific requirements in the course of licensing administration, for different categories of nuclear facilities and for different classifications of a single category of nuclear facilities.
