The State Council has recently issued the Decision on Temporarily Adjusting Certain Provisions of Relevant Administrative Regulations within the Pudong New Area of Shanghai Municipality (the "Decision").
According to the Decision, from the issue date of this Decision till December 31, 2018, the following provisions of relevant administrative regulations will be temporarily adjusted in the Pudong New Area of Shanghai Municipality. First, provisions in respect of the issue of licenses for the allocation of large-sized medical equipment as set forth in the second paragraph of Article 34 of the Regulations on the Supervision and Administration of Medical Devices, will be temporarily adjusted, accordingly, the licensing administration will not apply to the allocation of Class II large-sized medical equipment to private medical institutions within the pilot area; and the in-process and ex-post regulation will be intensified in this regard. Next, provisions in respect of approval formalities and approval timeframe for proposed enterprises producing feed additives or additive premixes as set forth in the first paragraph of Article 15 of the Administrative Regulations on Feed and Feed Additives, will not be implemented temporarily; instead, the notification and commitment system will apply. Furthermore, the Decision calls on relevant departments of the State Council and the Shanghai Municipal People's Government to accordingly adjust the rules and normative documents they have formulated and released, in a timely manner, and work out the administrative system suitable for the pilot scheme.
