Recently, the Ministry of Justice ("MOJ") has issued the Measures for the Handling of Violations in the National Uniform Legal Profession Qualification Examination (the "Measures"), effective as of the date of promulgation.
The Measures consist of five chapters divided into 29 articles, covering the handling of rules violations committed by the exam applicants, exam takers and other relevant persons, the handling of violations of the examination staff, the handling procedures for violations, etc. The Measures mainly regulate the cheating violations during the examination process, and, depending on the nature of the behavior and the severity of the circumstances, a violator may face three kinds of handling results respectively: cancellation of the test score for the current exam, cancellation of test scores of all exams and a two-year ban for taking the exam, and cancellation of test scores of all exams and a lifetime ban for taking the exam. The Measures state that, if a person is banned from signing up for or taking the National Uniform Legal Profession Qualification Examination for two years or life, the person concerned has the right to request a hearing within five working days after he or she is informed of the handling result, and if such person requests the hearing, the administrative organ of justice shall arrange for a hearing within 20 days.
