The Cyberspace Administration of China ("CAC") has recently issued the Administrative Provisions for Block Chain Information Services (Draft for Comment) (the "Draft for Comment") for public comment by November 2, 2018.
The Draft for Comment provides that, the CAC will, within its duties and powers, take charge of the supervision, administration and law enforcement of nationwide block chain information services. A block chain information service provider shall, within ten working days from its provision of such service, complete and submit the Record-filing Form for Block Chain Information Services which mainly covers the service provider, service category, form of services, application areas, address of the server, among other information, via the CAC's Block China Information Service Record-filing Administration System, to handle record-filing formalities. In the meanwhile, the Draft for Comment explicitly states that, a block chain information service provider shall, in accordance with the provisions of the Cyber Security Law of the People's Republic of China, certify the real identity of each block chain information service user by checking his or her identify card number or mobile phone number or by other effective means.
