The Ministry of Justice ("MOJ") has recently distributed the Opinions on Giving Full Play to Functional Roles to Create a Sound Legal Environment for the Development of Private Enterprises (the "Opinions").
The Opinions call for efforts to "accelerate the introduction, amendment, annulment and interpretation of relevant laws and regulations to provide a strong legal support for the development of private enterprises", "promote the strict, standardized, fair and civilized law enforcement to form a sound legal environment for the fair development of private businesses", "innovate and diversify public legal services to deliver legal services of good quality and high efficiency to private enterprises", and "step up publicity efforts in promoting the rule of law to instruct private enterprises to conduct business operations and corporate governance in compliance with laws". To achieve the above-said four goals, the Opinions further outline 20 measures, including "improving the system of laws and regulations to spur the development of the private sector" and "launching a comprehensive survey to sort out those laws, regulations and normative documents containing obstacles to the development of private businesses". Moreover, the Opinions clearly state that, it is planned to sort out, in a centralized manner by the end of 2018, relevant provisions in existing laws, regulations and normative documents that go against the principle of equal protection and are disadvantageous to the development of the private sector, and abolish or adjust such provisions in a timely fashion.
